The Site is operated by Exam Tutor Limited (“ExamTutor”, “we”, “us” or “our”), a company registered in Northern Ireland under company number NI726249, with its registered office at Office 29, 92 Castle Street, Area 1/1, Belfast, Northern Ireland, BT1 1HE. 3. Our products and what you receive

We sell digital 11+ and related entrance-examination practice papers and past papers, each supported by tutor-led video solutions and explanations. Our Products are digital content delivered and accessed online through your Account — nothing is posted to you. Unless stated otherwise on the relevant product page, each purchase gives you access to that Product for 12 months from the date of purchase. Each Product is described on its product page, and you should check the description before buying.

4. Your account

To buy and access Products you must create an Account. You must be at least 18 years old to register and to make a purchase; our Products are intended to be bought and managed by an adult — a parent, guardian or tutor — on behalf of the child preparing for an examination. You agree to provide accurate, current and complete information, to keep your login details confidential, and not to share your Account. You are responsible for all activity that takes place under your Account.

5. Orders, pricing and payment

All orders are subject to acceptance by us, and a contract between us is formed when we confirm your order and give you access to the Product. We may change our prices at any time, but changes will not affect orders we have already accepted. Payment is taken at the time of purchase through our third-party payment provider; we do not store your full payment-card details. You confirm that you are authorised to use the payment method you provide.

6. Your right to cancel, and digital content

Because our Products are digital content supplied online, special rules apply to cancellation. Under the Consumer Contracts Regulations 2013 you would normally have 14 days to cancel a purchase. However, when you buy a Product you expressly ask us to make it available to you immediately, and you acknowledge that once you have accessed or downloaded the Content you lose your right to cancel and to a refund under those Regulations. This does not affect your statutory rights in relation to Content that is faulty or not as described (see below).

7. Refunds and faulty content

As our Products are digital content with immediate access, we do not offer refunds once you have accessed or downloaded a Product. Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015: our Content must be as described, of satisfactory quality and fit for purpose, and if a Product is faulty or not as described you may be entitled to a repair, replacement or refund. If you think there is a problem with a Product, please contact us at info@examtutor.co.uk and we will help.

8. Licence and acceptable use

When you buy a Product, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Content for the private, non-commercial preparation of one child within your household. You may view the Content, and where the Site allows, download or print it, for that purpose only.

All Content, and all intellectual property rights in the Site and the Content, belong to Exam Tutor Limited or our licensors. Buying a Product does not transfer any ownership rights to you — you receive only the limited licence set out above. “ExamTutor” and our logo are our trade marks and may not be used without our permission.

10. Suspension and termination

We may suspend, restrict or terminate your Account and your access to the Content, without refund, if you breach these Terms — in particular if you share, copy or distribute the Content, or use it commercially without our agreement. We may also withdraw or suspend access where required for legal, security or technical reasons. You may stop using the Site and close your Account at any time.

11. No guarantee of results

Our Products are preparation and revision materials designed to help a child prepare for the 11+ and similar entrance examinations. They are not a guarantee of any particular result. We do not promise that using our Products will result in a child passing any examination or being offered a place at any school; outcomes depend on many factors, including the child’s own effort and ability and the requirements of the particular school or examination board. Nothing on the Site should be taken as a guarantee of exam success.

12. Availability and changes

We try to keep the Site and the Content available and up to date, and we may add to, update, improve or remove Content from time to time. We do not guarantee that the Site will always be available or uninterrupted, and we may suspend it for maintenance. We may also change these Terms from time to time; the version that applies to your purchase is the one in force when you place your order, and the current version will always be available on this page with a revised “Last updated” date.

13. Our liability to you

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and for any of your statutory rights as a consumer that cannot be excluded. Subject to that, we are not liable for any loss that is not a foreseeable result of our breach, for any business losses (our Products are supplied for private, domestic use), or for any indirect or consequential loss; and our total liability to you in connection with any Product is limited to the amount you paid for that Product.

We only use your personal information in accordance with our Privacy Policy, which explains what we collect and how we use it. Please read it together with these Terms.

15. Governing law and disputes

These Terms, and any dispute arising out of them or your use of the Site or our Products, are governed by the law of Northern Ireland, and the courts of Northern Ireland will have jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also be able to bring proceedings in your local courts.
